Important: By using Mockup Creator, you agree to these Terms and Conditions in their entirety. Please read carefully before using our services.
1. Acceptance of Terms
These Terms and Conditions (“Terms”) govern your use of the Mockup Creator application (“App”, “Service”) provided by OnionTavern (“Company”, “we”, “us”, “our”), a company incorporated in Dublin, Ireland. By accessing, downloading, installing, or using our App, you (“User”, “you”, “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.
2. Service Description
Mockup Creator is a design application that allows users to create, edit, and generate mockups and design materials. We offer both free and premium subscription-based features within the App.
2.1 Premium Subscription
Premium features are available through monthly subscription plans. Subscription benefits include but are not limited to:
- Access to premium templates and design elements
- Advanced editing tools and features
- Higher resolution exports
- Priority customer support
- Additional storage capacity
3. Subscription Terms and Payment
3.1 Billing
Subscription fees are billed monthly in advance and are non-refundable except as expressly stated in these Terms or as required by applicable law. Payment is due immediately upon subscription activation and will automatically renew each month unless cancelled.
3.2 Price Changes
We reserve the right to modify subscription pricing at any time with thirty (30) days’ notice. Price changes will apply to subsequent billing cycles and do not affect current subscription periods already paid for.
3.3 Automatic Renewal
Your subscription will automatically renew for successive monthly periods unless you cancel your subscription at least 24 hours before the end of the current billing period. You may cancel your subscription through your account settings or by contacting our support team.
4. Intellectual Property Rights
4.1 Our Rights
The App, including all content, features, functionality, software, designs, text, photographs, graphics, logos, icons, images, audio clips, and software, is owned by OnionTavern and is protected by Irish and international copyright, trademark, and other intellectual property laws.
4.2 User Content
You retain ownership of content you create using the App (“User Content”). However, by using our Service, you grant OnionTavern a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display User Content for the purposes of operating, improving, and promoting the Service.
4.3 Prohibited Use
You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App. You may not create derivative works based on the App or use it for any competitive purposes.
5. User Obligations and Prohibited Conduct
You agree to use the Service responsibly and in compliance with all applicable laws. You shall not:
- Upload, create, or distribute content that is illegal, harmful, threatening, abusive, defamatory, or obscene
- Violate any intellectual property rights of third parties
- Attempt to gain unauthorized access to our systems or other users’ accounts
- Use the Service for any unlawful or fraudulent purposes
- Interfere with or disrupt the integrity or performance of the Service
- Share your account credentials with third parties
- Use automated systems to access the Service without our express written permission
6. Termination
6.1 Termination by You
You may terminate your account at any time by cancelling your subscription through the App or contacting our support team. Upon termination, your access to premium features will cease at the end of your current billing period.
6.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if we believe your actions may harm our Service or other users. In cases of termination for cause, no refunds will be provided.
7. Disclaimers and Limitation of Liability
7.1 Service Availability
We strive to maintain service availability but do not guarantee uninterrupted access. The Service is provided “as is” and “as available” without warranties of any kind, either express or implied.
7.2 Limitation of Liability
To the maximum extent permitted by Irish law, OnionTavern shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.
8. Indemnification
You agree to indemnify, defend, and hold harmless OnionTavern, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney’s fees) arising from your use of the Service or violation of these Terms.
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.
10. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes through the App or via email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.
11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ireland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dublin, Ireland.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.
13. Force Majeure
OnionTavern shall not be liable for any failure or delay in performance under these Terms that is due to fire, flood, earthquake, pandemic, governmental acts, labor disputes, or other causes beyond our reasonable control.
14. Export Controls
The Service may be subject to export controls under Irish, EU, and international laws. You agree to comply with all applicable export control laws and regulations.
